Terms of Service & Safety Waiver

1. Acceptance of Terms

By registering for a membership, booking a trial pass, entering the premises of Velar Fitness & Wellness ("Velar", "Gym", "we", "our"), or utilizing our digital portal, you agree to be bound by these Terms of Service and Liability Waiver. If you do not agree to these terms, you must not use our facilities or services.

2. Assumption of Risk & Injury Waiver

You explicitly acknowledge that weight training, cardiovascular exercises, personal training, and the use of gym equipment involve risks of serious injury, permanent disability, or death. Velar Fitness & Wellness, its owners, directors, employees, and certified trainers SHALL NOT BE LIABLE for any injury, accident, physical harm, medical emergency, or loss of personal property sustained on the premises or during participation in any facility-sponsored program.

3. Heavy Lifting & Physical Capability Guidelines

• Know Your Limits: We strictly do not recommend heavy lifting or exertion beyond your individual physical capability or experience level.
• Spotter Responsibility: Members must utilize qualified spotters or safety pins during heavy barbell exercises (such as bench presses and squats). Velar is not responsible for accidents resulting from unspotted lifts.
• Medical Clearance: You represent that you are in good physical health and have consulted a physician before undertaking any rigorous exercise regimen.

4. Membership Fees & Strict No-Refund Policy

• All Sales Final: All membership fees, package purchases, personal training sessions, and promotional pass payments are strictly non-refundable under any circumstances.
• No Pro-Rata Refunds: Membership activations, annual tiers, or short-term packages cannot be refunded, transferred, or exchanged due to relocation, personal scheduling conflicts, medical conditions, or gym closure resulting from force majeure events.

5. Code of Conduct & Facility Rules

Members are required to re-rack weights after use, wipe down equipment after exercise, adhere to proper gym attire, and maintain respectful conduct toward staff and fellow members. Velar reserves the right to revoke membership privileges immediately without refund for violations of safety or conduct rules.

6. Governing Law

These terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Udaipur, Rajasthan.
